English Family Law
In the UK, there is a specific branch of law that is dedicated solely to cases that involve the family. These include legal disputes that touch upon child custody, child support, divorce, as well as the dissolution of the property regime and distribution of assets after marriage – which of course, will be based either on a prenuptial agreement or on the law itself in the absence of such an agreement. Furthermore, it is worth noting that not all cases that involve English Family Law will actually be brought before The Family Court. A good family law solicitor should be able to easily spot when a case may be open for an out of court settlement to the satisfaction of the client and the adverse party. Due to the sensitive nature of the cases that are involved in UK Family Law, family law solicitors are bound by the code of their profession to exercise the utmost sensitivity in handling the cases brought before them by their clients.
Solicitors Vs Barristers in English Family Law
Unique to the UK and in English family law, there are two types of lawyers that handle family law matters both in and out of courts. Lawyers practicing family law in the UK are generally subdivided into either solicitors or barristers. As a client, what you need to know is that when you go to see a lawyer, you will generally be looking for a family law solicitor to give you advice on what steps you can take in order to secure your legal rights in a legal dispute involving family law. Furthermore, a family law solicitor may also represent your interests in negotiations with the adverse party.
However, for legal representation of your case in The Family Court, only a barrister may do this. In general, it is not the client who works with the barrister but the family law solicitor. Basically, the family law solicitor will provide the barrister with the brief of the case, who will then study it carefully in order to plead the case in court.
If you are in the UK, then you are probably aware of the reason for this divide in the legal profession. It is both historical as well as operation. Traditionally, it has always been this way, but the operational reason for it is because in the past, people needed two types of lawyer: one who could give them quick advice on civil cases, and another type who could represent them in a criminal case.
